Simply stated a living sentient man or woman has to be a member to establish and guarantee the lawful rights and protections which allow unfettered access and exchange of the particular expressions of religious practice and healing which we claim as indigenous.
1) Participation and support of the human right to receive and exchange traditional, indigenous and natural medicine, therapy, healing, ceremony, education and or counseling.
2) Defines the exchange of services as a traditional, indigenous and natural medicine, therapy, healing, ceremony, education and or counseling and not a legal, financial, medical, psychological, therapeutic or massage service as defined and regulated by a governmental authority, BAR, or “licensing” board.
3) Establishes that neither the member nor the minister is “the public” as defined by law and therefor not to be regulated as such.
4) Establishes the sincerely and firmly held conviction that performing, sharing and participating in ceremony, sacrament and healing is a right of indigenous church expression of both Tribal and Religious freedom principles, statute and established precedent.
5) Member / communicant - minister privilege (“Right to privacy” between healer, minister and the member receiving the service). Please note: No BodyMind Church of Hope membership = no member / communicant- minister privilege. When both healer / minister and member / communicant are members of BodyMind Church of Hope there is no service to the public, there is no compelling interest of government to intervene. In fact interfering is specifically prohibited.
6) If man or woman is not a BodyMind Church of Hope member there is no expressive private association membership contract, and no protections afforded to expressive private association among members.
7) If man or woman is not a member there are no tribal religious freedoms or protections for such under AIRFA, RLUIPA, Title 42, 25, 18 etc.
8) If man or woman is not a member there is no protection from liability, nor arbitration agreement for dispute between members.
9) If man or woman is not a member there is no legal contract or understanding that all services, counseling, healings etc. are tribal indigenous religious expressions. Leaves the door open to misunderstanding either in the moment or at some future date. Also leaves the door open to a relative, partner, legal or medical person misinterpreting the nature of the services.
10) Services rendered without clearly establishing the nature of the relationship as a religious exchange, are subject to being interpreting as a secular service which would place them under the jurisdiction of various state medical practices or legal acts. Clearly establishing the nature of the relationship between the BodyMind Church of Hope, minister and the member reduces and or eliminates confusion and misunderstanding.
11) Members attest they are here solely on their own behalf and not as an agent or representative for any Federal, State, County, or City Agencies.
Furthermore, members do not represent any Massage Board, Medical Board, Zoning Board, Licensing Board, BAR, etc. Neither are they on a mission of entrapment or investigation on behalf of these or any other agencies. Member confirms they are not a governmental actor. Any attempt to take information or matters outside this jurisdiction could result in a fine of up to $5,000.00.
12) Member agrees to hold the Director(s), Ministers, Healers, Practitioners, however they are titled, staff and other members of BMCH harmless from any and all unintentional liability resulting from such care, except for harm that results from instances from a clear and present danger of substantive evil as determined by SMOCH, as stated and defined by the US Supreme Court.
Notice is hereby given to any person who enumerated in this Declaration that they may be in violation of our Civil and Constitutional Rights, Title 42, U.S.C 1983 et seq. Title 18, Sec 242, receives a copy of the Declaration, and who, acting under the color of law, intentionally interferes with the free exercise of the Rights retained by BMCH members under the Ninth Amendment, as enumerated in this Declaration, that they may be in violation of our Civil and Constitution Rights, Title 42, U.S.C 1983 et seq. Title 18, Sec 241 and Sec 242.
